Terms of Service

1. Acceptance of terms

By accessing or using Lyvera (the “Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. If you use the Platform on behalf of an organization, you represent that you are authorized to accept these terms on that organization’s behalf.

2. What Lyvera is

Lyvera is a marketing and inquiry-routing platform operated by Aspiring for Success LLC. Lyvera does not provide care, does not recommend a particular provider, and does not guarantee provider availability. Lyvera is not a government agency and is not affiliated with any state program.

3. Provider partnerships

Participating providers operate independently of Lyvera. The terms of any provider partnership — including scope, territory, fees, and obligations — are set out in a separate partnership agreement between the provider and Aspiring for Success LLC. Nothing in these terms creates an agency, employment, joint-venture, or franchise relationship between Lyvera and any participating provider.

4. Consumer inquiries

Families and individuals may submit inquiries through the Platform. Lyvera routes those inquiries to participating providers based on capacity and territory. How consumer inquiry information is collected, used, and shared is described in the Consumer Inquiry Privacy Notice. Lyvera does not control, and is not responsible for, the services a participating provider ultimately delivers.

5. Acceptable use

You agree not to use the Platform to:

• violate any applicable law or regulation, or infringe the rights of any third party;
• submit false, misleading, or fraudulent information, or impersonate any person or entity;
• interfere with, disrupt, or attempt to gain unauthorized access to the Platform, its systems, or its data;
• scrape, harvest, or collect information from the Platform by automated means without prior written permission; or
• use the Platform for any purpose other than the marketing and inquiry-routing functions it is intended to provide.

6. Intellectual property

The Platform and its contents — including software, text, graphics, logos, and the Lyvera name and marks — are owned by Aspiring for Success LLC or its licensors and are protected by intellectual property laws. These terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for its intended purpose. No other rights are granted, and all rights not expressly granted are reserved.

7. Disclaimers

The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Lyvera does not warrant that the Platform will be uninterrupted, error-free, or secure, and makes no guarantee of any particular outcome or of provider availability. Any decision to engage a participating provider is yours alone.

8. Limitation of liability

To the fullest extent permitted by law, Aspiring for Success LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Platform. 9. Changes to these terms

Lyvera may update these terms from time to time. When we do, we will revise the “Last updated” date above. Material changes may be communicated through the Platform or by other reasonable means. Your continued use of the Platform after changes take effect constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by the laws of the State of [ ], without regard to its conflict-of-laws principles, and any dispute arising out of or relating to these terms or the Platform will be subject to the exclusive jurisdiction of the courts located in [ ].
